9. Limitation of liability
In no event shall either party’s aggregate liability exceed the total fees paid in the preceding three (3) months the total fees paid or payable in the twelve (12) months preceding the claim, except for breaches of Section 7 (Confidentiality) or a party’s indemnification obligations.
